Privacy Policy and Cookies

This document is a description of the privacy policy and the use of cookies used by the Polish Association of Alternative Fuels with its registered office in Warsaw at ul. Fabryczna 5A, 00-446 Warsaw (Administrator). It defines the rules, method of processing and use of data and information from persons using the website/mobile application www.evexp.pl (Website), applications, services and other functions from the Administrator.
Please read this policy carefully. By accessing or using this website and sending us any personal data, the User accepts the terms of this privacy policy.
The administrator of personal data is the Polish Alternative Fuels Association with its registered office in Warsaw at ul. Fabryczna 5A, 00-446 Warsaw, registered in the register of associations of the National Court Register kept by the District Court for the Capital City of Warsaw Warszawa in Warsaw, 12th Commercial Division of the National Court Register, under KRS number 0000643156, REGON: 365877690, NIP: 5252684377 (Administrator).

I. Principles of personal data protection

1. We take special care to ensure that all personal data are processed in accordance with the purpose for which they were collected and used in accordance with the scope of granted permissions (consents), areas of processing permitted by law and services provided to Website Users.
2. All personal data is processed in a manner consistent with the requirements of generally applicable law, in particular in accordance with Regulation (EU) 216/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46 / EC (GDPR), the Act of May 10, 2018 on the protection of personal data (i.e. Journal of Laws of 2019, item 1781, as amended), the Act of July 18, 2002 on the provision of electronic services (i.e. Journal of Laws of 2020, item 344, as amended) and the Telecommunications Law Act (i.e. Journal of Laws of 2020, item 875, as amended). ), including in accordance with the scope of consents granted by the User.
3. We make sure that the processing of personal data is carried out in accordance with the principles of substantive correctness and adequately to the purposes for which they were collected.

II. Collection of personal data

Personal data is collected as follows:

1. Personal data provided by Users:
During and in connection with the registration and updating of an account on the Website: name and surname, date of birth, telephone number, e-mail address, User name (login) and password, place of residence, profile picture, payment or bank details (including related verification of the account), details of the carsharing operator or the entity renting the vehicle, customer number, card number, number of rentals in a month (if the User uses the car on the basis of carsharing or rental), number of the Customer’s card in the network of GreenWay Polska Sp. z o. o. with its registered office in Gdynia, Al. Zwycięstwa 96/98, 81-451 Gdynia (if the User has one),
2. demographic data obtained through surveys,
3. content provided by Users as part of using the Website: information provided when contacting the Website’s customer service, ratings, comments and reviews issued, data provided as part of using the Website’s forum,
2. Data created while using the services:
1) location data: exact or approximate location data from Users’ mobile devices, distance traveled by vehicle, if Users have allowed it,
2) data on the use of services: the way Users use the Website, in particular access dates and times, charging time, distance traveled by vehicle, payment data,
3. Data collected by saving cookies in end devices (so-called cookies):
Information related to the use of the Website: login time, pages viewed, application errors and other system events, browser type, third party websites used by Users before using the Website,
4. Vehicle data provided by Users:
During and in connection with the registration and updating of the account on the Website: the use of the vehicle, type, make, model of the vehicle, battery capacity, engine power, year of manufacture, registration number, VIN number, date of first registration.

III. Use of personal data

1. Personal data is used for the purposes of providing services by the Administrator and the related legal obligations of the Administrator – pursuant to art. 6 sec. 1 a), b) and c) GDPR. The data is used to provide, customize, maintain and improve our services, and in particular to:
1) creating and updating User accounts,
2) enable and process payments for our services,
3) carry out internal operations necessary to provide our services, including software bug fixes and operational issues, charging station troubleshooting, data analysis, testing and research, and monitoring and analyzing usage and activity trends,
4) sending inquiries to the Website’s customer service employees,
5) solving problems reported by Users,
6) supervising and improving the Website’s customer service,
2. In the event of obtaining the appropriate consent, the data is also used for marketing purposes carried out by means of electronic communication, in particular through the use of telecommunications terminal equipment, for direct marketing purposes, in accordance with art. 172 of the Act of July 18, 2002 Telecommunications Law (i.e. Journal of Laws of 2020, item 875, as amended) and e-mail, in accordance with art. 10 of the Act of July 18, 2002 on the provision of electronic services (i.e. Journal of Laws of 2020, item 344, as amended) pursuant to art. 6 sec. 1 a) GDPR.
3. We process data for the period necessary to achieve the purposes for which they were collected, and additionally for the period in which we are obliged to do so under generally applicable law.
4. In addition, we process personal data based on the User’s consent as part of voluntary surveys. Users’ answers to surveys of this type are collected with the User’s consent and are deleted when they are no longer needed for the purposes for which they were collected.
5. We ensure confidentiality, integrity and accountability of personal data processed by us.
6. The processed personal data may be made available to other recipients – our employees, associates, companies affiliated with the Administrator by capital, entities entrusted by the Administrator with the processing of personal data (including accounting offices, law firms, companies providing IT services, couriers), entities authorized to on the basis of generally applicable law, as well as entities for which the Administrator provides services or entities whose services he uses, if the performance of these services involves the need to provide data that the Administrator has received from Users (in particular entities making payments).
7. The processed personal data is not transferred to countries outside the European Union and the European Economic Area. In the event that personal data are to be transferred to a country outside the European Union and the European Economic Area, Users will be informed in advance.

IV. Detailed information about cookies

1. The website uses cookies.
2. Cookie files (so-called „cookies”) are IT data, in particular text files, which are stored in the Website User’s end device and are intended for using the Website’s websites.
3. The entity placing Cookies on the Website User’s end device and accessing them is the Website operator.
4. Cookies are used for the following purposes:
1. creating statistics that help to understand how Website Users use websites, which allows improving their structure and content, also using Google Analytics;
2. adapting the content of the Website to the User’s preferences and optimizing the use of the Website.
5. The Website uses two basic types of cookies: „session” (session cookies) and „permanent” (persistent cookies). Session cookies are temporary files that are stored on the User’s end device until logging out, leaving the website or turning off the software (web browser). „Permanent” Cookies are stored in the User’s end device for the time specified in the parameters of Cookies or until they are deleted by the User.
6. The web browser usually allows cookies to be stored on the User’s end device by default. Website users can change the settings in this regard. The web browser allows you to delete or block cookies. Detailed information on this subject can be found in the help or documentation of the User’s web browser.
7. Restrictions on the use of cookies may affect some of the functionalities available on the Website.

V. Server logs

1. Information about some Users’ behavior is subject to logging in the server layer. These data are used only to administer the website and to ensure the most efficient service of the hosting services provided.
2. Browsed resources are identified by URL addresses. In addition, the following may be recorded:
1) inquiry arrival time,
2) reply sending time,
3) name of the User’s station,
4) information about errors that occurred during the execution of the http transaction,
5) URL address of the page previously visited by the User (referrer link) – if the Website was accessed via a link,
6) information about the type of the User’s device,
7) information about the User’s web browser,
8) information about the IP address, including information from which country the User logs in.
3. The data presented above are not associated with specific people browsing the Website.
4. The above data is used only for the purposes of administering the Website and the server.

VI. Information security and storage

We ensure the security of personal data through appropriate technical and organizational measures to prevent unlawful data processing, disclosure to unauthorized persons and their accidental loss, destruction or damage.

VII. User Rights

1. Providing personal data to the extent necessary for the implementation of the services offered by the Administrator is mandatory, and in the remaining scope is voluntary.
2. The administrator respects the rights of each person whose data he processes:
1) access to data,
2) rectification of data,
3) deletion of data,
4) processing restrictions,
5) data transfer,
6) raise an objection,
7) to be forgotten.
3. If the processing is based on the consent of the data subject, that person has the right to withdraw consent at any time, with the proviso that this will not affect the lawfulness of processing based on consent before its withdrawal.
4. The person whose data we process may exercise his rights by sending a letter to us – to the address indicated above and by e-mail to the address: biuro@pspa.com.pl – in which he will present his requests.
5. The person whose data we process has the right to lodge a complaint with the supervisory authority if he/she considers that his/her rights have been violated.

VIII. Privacy policy changes

Changes to this privacy policy may be affected by changes in the legislative sphere regarding the protection of personal data, as well as other factors. Users will be immediately informed about any changes on the website www.evexp.pl.
